Foreclosure Inquiries Rise: Homeowner Financial Stress Reaches Highest Level Since 2020

Foreclosure inquiries continued to increase during the second quarter of 2026, reaching their highest level since March 2020 and signaling that financial pressure on many American homeowners is growing. New data suggests that more borrowers are seeking legal assistance as they struggle with mortgage payments, rising housing costs, and increasing household debt.

According to the latest LegalShield Consumer Stress Legal Index (CSLI), foreclosure inquiries have now increased for three consecutive quarters. Historically, this index has been a strong leading indicator of actual foreclosure filings, often moving one to two quarters ahead of official foreclosure statistics.

Foreclosure Pressure Continues to Build

LegalShield believes much of the recent increase is linked to the expiration of pandemic-era FHA mortgage relief programs last year. Many borrowers who previously received payment assistance are now facing missed payments, exhausted loan modification options, and higher monthly housing expenses.

The overall Consumer Stress Legal Index climbed to 74.6, up 9.4% compared with a year ago and 2.3% from the previous quarter.

The Foreclosure Index increased to 52.5, rising 12.2% year over year and 5.6% from the first quarter. The index reached a quarterly high of 54.7 in May, its strongest reading in more than six years before easing slightly in June.

Bankruptcy Inquiries Rise Even Faster

While foreclosure concerns continued to grow, bankruptcy inquiries showed the largest increase among all categories.

The Bankruptcy Index reached 41.3, rising 28.7% from a year earlier and 5.1% during the quarter. The steady monthly increases suggest more households are experiencing financial strain beyond housing costs alone.

Meanwhile, the Consumer Finance Index remained relatively stable at 107.7, posting a modest 1.2% annual increase.

Rising Housing Costs Add Pressure

Higher mortgage payments are only part of the challenge facing homeowners.

Many borrowers are also dealing with rising escrow payments as property taxes and homeowners insurance continue to increase. In many markets, taxes and insurance now account for more than one-fifth of a typical monthly mortgage payment, with some higher-cost metro areas seeing even larger shares.

Insurance premiums are also expected to continue rising during 2026, adding additional pressure for homeowners already managing tight household budgets.

Household Debt Remains Near Record Levels

Growing consumer debt is another reason financial stress continues to increase.

Recent data shows total U.S. household debt has reached approximately $18.8 trillion, while credit card balances climbed to $1.25 trillion. Mortgage delinquencies have also edged higher, reflecting the growing challenges facing many families as borrowing costs remain elevated.

Legal professionals report that many consumers seeking help are struggling to balance mortgage payments, auto loans, and credit card debt while dealing with higher living expenses and slower income growth.

Regional Differences Stand Out

Financial stress is not increasing evenly across the country.

The South reported the highest overall consumer stress and bankruptcy activity, while the Midwest recorded the largest annual increase in foreclosure inquiries. The West experienced the strongest quarterly jump in bankruptcy inquiries, reflecting growing financial pressure in several markets.

The Northeast showed a different pattern, with both foreclosure inquiries and overall consumer stress declining compared with a year ago.

Outlook

The continued rise in foreclosure and bankruptcy inquiries suggests many households remain under financial pressure despite a stable labor market. As pandemic-era mortgage assistance programs fade and housing costs remain elevated, more homeowners may face difficult financial decisions in the months ahead.
